REFUSING A CHEMICAL TEST

🗣️ “Driving is a privilege, not a right.”

If you refuse a chemical test and go to trial, you will likely hear the prosecutor say this to the jury, and they are correct.

By driving in Indiana, you have already consented to take a chemical test when requested to by an Indiana law enforcement officer. If you refuse a chemical test, your license will be suspended by the Indiana Bureau of Motor Vehicles.

If this is your only OWI, this suspension will be for a one (1) year. If you have a prior OWI conviction, the suspension will be for two (2) years. Specialized driving privileges are NOT available to those who refuse a chemical test, so a refusal can have devastating consequences for those who drive to themselves of their children to work or school.

✋ Moreover, your refusal can be used against you at trial for the consciousness of guilt.
